Terms of Service

1. Introduction & Acceptance

These Terms of Service govern your use of the Unqo Properties mobile application, website (unqoproperties.com), agent portal, and related services, operated by Unqo Digital Solutions CC, registered in the Republic of Namibia.

By using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement under the Electronic Transactions Act 4 of 2019.

2. Eligibility

Property Seekers

Must be at least 16 years of age and have legal capacity to agree to these Terms.

Agents & Agency Administrators

• Must be at least 18 years of age
• Must hold a valid NamREC registration number
• Must hold a current, valid Fidelity Fund Certificate (FFC)
• Must have legal capacity to enter into a debit order mandate
• Agency accounts must be registered businesses in good standing

4. Agent Verification

All agent accounts undergo manual review before listings go live, including verification of NamREC registration, FFC validity, and identity documents. Rejected applications receive a reason by email and may reapply after addressing the rejection.

Unqo Properties may revoke agent status if NamREC registration lapses, FFC expires without renewal, or an agent breaches these Terms.

5. FFC Requirements

• A current, valid FFC is mandatory for all agent accounts
• FFC must be uploaded during the agent application process
• A reminder is sent 30 days before the declared FFC expiry date
• If FFC expires without renewal, the account is suspended and listings hidden
• Upon approval of a renewed FFC, the account is reinstated

8. Debit Order & Payment

Subscriptions are billed monthly via debit order through DPO Pay. By submitting banking details and accepting the mandate, you authorise Unqo Properties to debit your account on the selected date each month.

If a debit fails, a 7-day grace period applies. After the grace period, the account is suspended. Unqo Properties does not store raw bank account numbers — all banking details are tokenised by DPO Pay.

9. Projected Reach & View Counts

View counts displayed on the Unqo Properties platform represent projected reach based on our audience amplification model. During the early growth phase of the platform, displayed view figures are calculated by applying a reach multiplier (between 6.0x and 8.5x) to recorded unique property views. This multiplier is designed to reflect the estimated total audience exposure of a listing, including indirect reach through sharing, referrals, and platform discovery.

The multiplier is stable and consistent per listing — it does not change between sessions or users. All agents on the platform are subject to the same amplification model, ensuring fairness and consistency across all listings.

This amplification model will be removed once the platform reaches 200 organic daily active users, at which point only verified unique view counts will be displayed. Unqo Properties reserves the right to adjust or remove the amplification model at any time.

10. Property Listings

Agents are responsible for the accuracy of all listing information. Prohibited: duplicate listings, false pricing, misleading descriptions, listings without a valid mandate, and listings by suspended accounts.

11. Prohibited Conduct

• Providing false information during registration or application
• Attempting to circumvent the agent verification process
• Scraping or reproducing Platform content without permission
• Interfering with the Platform or its infrastructure
• Using the Platform for any unlawful purpose
• Impersonating another agent, agency, or Unqo Properties staff

11. Suspension & Termination

Unqo Properties may suspend or terminate accounts for breach of these Terms, non-payment, lapsed credentials, or fraudulent activity. You may cancel at any time — cancellation takes effect at the end of the billing period.

12. Intellectual Property

All Platform content, design, software, and branding is owned by Unqo Digital Solutions CC. Property listing content remains the property of the listing agent. By uploading content, you grant Unqo a licence to display it on the Platform.

13. Disclaimers & Limitation of Liability

Unqo Properties is a listing platform. We do not participate in property transactions or provide valuations. The Platform is provided on an as-is basis. To the maximum extent permitted by Namibian law, Unqo Digital Solutions CC is not liable for indirect or consequential damages arising from your use of the Platform.

14. Governing Law

These Terms are governed by the laws of the Republic of Namibia. Disputes shall be subject to the exclusive jurisdiction of the courts of Namibia. We encourage informal resolution first — contact us at [email protected].

15. Changes to These Terms

We will notify you by email at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance.
